The agreement between you and LucentHost. By signing up for any plan or service, you accept these terms.
LucentHost provides web hosting, domain registration, cloud hosting and SSL certificates. All customers must agree to these terms and conditions before signing up for any of the hosting plans or services offered on LucentHost.
You agree to use only licensed and legal third-party software in connection with your use of our services. LucentHost reserves the right to suspend or cancel a customer's access to any or all services provided, at any time, where we determine that an account has been used inappropriately or otherwise in breach of these terms.
You agree to protect, indemnify and hold LucentHost harmless from any and all stipulations, liabilities, losses, expenses and claims, together with reasonable legal fees assessed against LucentHost, its agents, customers, officers, employees and administration, that may arise from or result from any service provided, performed or agreed to be performed, or any product sold by you, your agents, employees or assigns.
You agree to defend, indemnify and hold LucentHost harmless against liabilities arising out of:
LucentHost reserves the right to refuse service or access to its servers to anyone. Our services must be used for lawful purposes only. The transmission, storage or presentation of any information, data or material in violation of Nigerian law, or of the law applicable in the jurisdiction where the service is hosted, is prohibited.
The following applies to every LucentHost service without exception, including anonymous hosting. There is no plan on which any of this is permitted:

Anonymous hosting exists for customers who need a censorship-resistant presence online, and it is governed by a narrower content policy than our standard plans. Specifically:
This is not an exemption from the law. Everything listed under "absolutely prohibited on every plan" applies to anonymous hosting in full, without exception. In particular, child sexual abuse material, trafficking, terrorism-related content and attacks on other systems will result in immediate termination without refund and referral to law enforcement.
Use of our service to transmit unsolicited commercial email or unsolicited bulk email is expressly prohibited, and violations carry severe penalties.
On notification of an alleged violation we open a full investigation, during which we may restrict your access to the network to prevent further violations. Where a customer is found to have breached this policy we may, at our sole discretion, restrict, suspend or terminate the account. We reserve the right to pursue civil remedies for costs associated with investigating a substantiated violation, and we will notify law enforcement where we believe an offence has been committed.
Anyone using our service to host websites or services that support spammers, or that cause any of our IP space to be listed in a spam database, will have their accounts suspended immediately and an administrative fee of $100 charged to the account. The account will not be unsuspended until you agree to remove all traces of the offending material immediately on reconnection. A first violation results in a warning and a review of the account for possible termination. A second violation may result in immediate termination. Severe violations may result in immediate and permanent removal of the account from our network without notice.
We operate a zero-tolerance policy on posting messages or commercial advertisements that violate the rules, regulations or charter of any newsgroup or mailing list. Commercial messages that are permitted under the rules of a newsgroup or mailing list, or that are solicited by the recipients, are allowed.
We also prohibit hosting a publicly accessible open relay SMTP service or an anonymous remailer service, for any purpose whatsoever.
If your account exceeds its bandwidth limit we will inform you. If you do not wish to purchase additional bandwidth or upgrade the account, and continue to exceed the limit, the account will be suspended until you take steps to keep within the limit or upgrade, whichever comes first. The account is reactivated in the following month.
If you fail to complete our account verification process, no refund will be provided under any circumstances.
You are responsible for any misuse of your account, and you must take steps to prevent others from gaining unauthorised access to it. You may not use your account to breach the security of another account, or to attempt unauthorised access to another network or server.
You may not attempt to circumvent user authentication or the security of any host, network or account. This includes accessing data not intended for you, logging into or using a server or account you are not expressly authorised to access, and probing the security of other networks. The use or distribution of tools designed to compromise security, such as password guessing programs, cracking tools or network probing tools, is prohibited.
You may not attempt to interfere with service to any user, host or network, including flooding networks, deliberately overloading a service, or attempting to crash a host. Users who violate systems or network security may incur criminal or civil liability. LucentHost will cooperate fully with investigations of security violations at other sites, including with law enforcement authorities investigating suspected criminal violations.
Service interruptions or downtime arising from scheduled maintenance by LucentHost or our network providers do not count towards the uptime guarantee. LucentHost is not liable in any way for the failure of third-party services.
LucentHost will not be liable for failure or delay in performing its obligations where that failure or delay is due to circumstances beyond its reasonable control. These include acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labour disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third-party services including DNS propagation, failure of third-party software or hardware, and the inability to obtain materials, supplies, power or equipment needed to provide the services.
Where payment is made by credit card, debit card or PayPal, the account is set up immediately once payment is confirmed.
The six-day money-back guarantee applies only to first-time signups. Second and subsequent signups are not eligible. If you have held an account with us before, cancelled it and signed up again, or if you have opened a second account, you are not eligible for a refund.
The money-back guarantee is available on shared hosting, anonymous hosting, reseller hosting, and WordPress hosting.
There is no refund for domain registration, transfer or renewal, cPanel, Plesk, Webuzo, any other control panel, cloud services, VPS, paid support, SSL certificates, SpamExperts, Windows OS, SQL, or any other paid licence.
No refund will be made where your services are suspended or terminated for cause.
Any hosting account suspended for overdue payment must be renewed and reactivated within the grace period below, or data will be permanently lost.
This policy also applies to accounts suspended for violations of these terms. In those cases you must contact us within the relevant grace period to resolve the issue and request reactivation. If no action is taken within the allotted time, the service is terminated automatically.
We reserve the right to refuse, cancel or suspend service at our sole discretion. LucentHost reserves the right to modify or change these terms at any time, and all customers are bound by the most recent version published on this website.
